These Terms of Service ("Terms") govern your access to and use of Pusulam ("Platform"), operated by Eskalate LLC ("Company", "we", "us", or "our"), a Delaware corporation located at 112 Capitol Trail, Suite A66, Newark, DE 19711.

By creating an account or using the Platform, you agree to these Terms. If you do not agree, do not use the Platform.

1. About the Platform

Pusulam is a collective intelligence platform where users make predictions on real-world events using virtual credits called "Oy Hakki" (Vote Rights). Pusulam is not a gambling, betting, or financial trading platform. No real money is wagered, won, or lost.

2. Eligibility

You must be at least 13 years old to use the Platform. By creating an account, you represent that you meet this age requirement. Users under 18 should have parental or guardian consent.

3. Accounts

  • You must provide accurate information when registering.
  • You are responsible for maintaining the confidentiality of your password.
  • You may not create multiple accounts.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

4. Oy Hakki (Vote Rights)

  • Oy Hakki is a virtual credit used within the Platform. It has no monetary value and cannot be exchanged, sold, or converted to real currency.
  • New accounts receive 50 Oy Hakki. Users receive 3 free Oy Hakki daily.
  • Oy Hakki may be purchased through the Platform for use within the Platform only.
  • Purchases of Oy Hakki are final and non-refundable.
  • We reserve the right to modify Oy Hakki balances, pricing, or distribution at any time.

5. Premium Subscription

  • Premium membership is available for $5/month.
  • Subscriptions are billed monthly through Stripe.
  • You may cancel your subscription at any time. Access continues until the end of the billing period.
  • A 7-day free trial is available once per account.

6. User Conduct

You agree not to:

  • Use bots, scripts, or automated tools to interact with the Platform.
  • Manipulate market outcomes or collude with other users.
  • Post offensive, illegal, or harmful content in comments or suggestions.
  • Attempt to gain unauthorized access to other accounts or Platform systems.
  • Use the Platform for any form of real-money gambling or betting.

7. Content and Intellectual Property

  • User-generated content (comments, predictions, suggestions) remains your intellectual property.
  • By posting content, you grant us a non-exclusive, worldwide license to display, distribute, and translate your content within the Platform.
  • The Platform's design, code, branding, and AI systems are owned by Eskalate LLC.

8. Market Resolution

  • Markets are resolved based on verifiable, publicly available information.
  • Resolution methods include: real-time price APIs, official government announcements, and verified news sources.
  • We strive for accuracy but do not guarantee error-free resolution.
  • If you believe a market was resolved incorrectly, you may report it through the Platform's feedback system.

9. AI Features

  • The Platform uses AI (powered by Anthropic's Claude) for market analysis, chat assistance, and content translation.
  • AI-generated content is informational only and does not constitute financial, legal, or professional advice.
  • AI features may produce inaccurate or incomplete information.

10. Third-Party Services

The Platform integrates with:

  • Stripe for payment processing
  • Resend for email notifications
  • CoinGecko, Frankfurter for market data
  • Polymarket, Manifold Markets for probability reference data
  • Google Analytics for usage analytics
  • Neon for database hosting
  • Vercel for application hosting

Each third-party service has its own terms and privacy policies.

11. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE:

  • The accuracy of market probabilities or resolutions
  • Uninterrupted or error-free service
  • The accuracy of AI-generated content
  • That Oy Hakki balances will be preserved in all circumstances

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ESKALATE LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE PLATFORM. SINCE OY HAKKI HAS NO MONETARY VALUE, ANY LOSS OF OY HAKKI DOES NOT CONSTITUTE FINANCIAL LOSS.

13. Modifications

We may modify these Terms at any time. Material changes will be communicated through the Platform or via email. Continued use after changes constitutes acceptance.

14. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.
